Terms and Conditions

INFINITE MELODIES ARTS AND MUSIC, LLC. 

EFFECTIVE DATE: March 21, 2021

The following Terms and Conditions apply to all lesson agreements made between Infinite Melodies Arts and Music, LLC. (referenced as “IMAM”) and its students and the parents/guardians of its students ( referenced as “the student/parent”) and includes references to the Infinite Melodies Program students. The Terms and Conditions described below may seem relatively detailed but have been developed in fairness for both student/parent and director. As IMAM is a new social enterprise that functions with minimal margins, such set boundaries are not a reflection of how awesome IMAM families are. Each individual will be approached in good faith, and we hope that this is reciprocated.

1. TERM DATES

1a. Teaching weeks at IMAM run from February to December, with professional development and preparation during the months of January and July included. Details are sent out before every seasonal term begins.

1b. At all times, it is the responsibility of the student/parent to be aware of the first and last dates of the term.

2. COMMUNICATIONS

2a. All correspondence is sent out to the student/parent by email or text. If this is a problem, please let IMAM know.

2b. It is the responsibility of the student/parent to make IMAM aware of any changes to their contact details. IMAM will not be held responsible for any missed communications, late/overdue payments, missed lessons, etc. if this is due to incorrect contact information.

2c. Due to the size of our new student roll, most of IMAM’s communication is done via bulk delivery services e.g. mail merge, therefore there is a level of potential error associated with this. If you notice something incorrect e.g. lesson details or account details, let IMAM know via email to info@Infinitemelodies3.com.

3. TIMETABLING OF LESSONS

3a. The student/parent will be informed of the lesson- whether virtual or face-to-face day, time, and the date of their first lesson before their teaching commences, either by phone, text, or by email. IMAM will aim to confirm all the lesson details by email/text but does not guarantee that this will be the case if it deems sufficient confirmation has been provided by other means.

3b. If the agreed lesson times or days need to be changed, the student/parent will be contacted as far in advance as possible and alternative arrangements will be made to continue the lessons at times and days that suit the student and IMAM.

4. ABSENCES

4a. Individual Absences

4.a.i. If the student is unable to attend a lesson, please let IMAM know at the earliest time possible, either by text at (501) 420-3597 or by email to Taniesha.Wiley@Infinitemelodies3.com.

4.a.ii. Where less than 24 hours' notice is given for missing a lesson, no catch-up lesson or credit will be given. 

4.a.iii. Where at least 24 hours' notice of the intended absence is given, this is deemed an “explained absence.”

4.a.iv. IMAM will arrange a catch-up lesson for up to two lessons per term for explained absences with you at a mutually agreeable time. This often happens in the form of an extra 30-minutes on your next lesson or an extra 15-minutes on top of your next two lessons or if this isn’t possible with IMAM’s schedule, they will choose a day or two during the first week of the term break to provide this lesson.

4.a.v. IMAM is trained to go above and beyond to help work these catch-up lesson timings out with you, however, If you decide that you would prefer to not have this, this lesson is considered forfeited. Please note the responsibility is on the parent/guardian to jointly work with IMAM to find a mutually beneficial time. The IMAM team will diligently help, so please let us know if you feel this is not happening.

4.a.vi. It is only by managerial discretion that customer credit is placed on a student's account to the value of a missed lesson. Customer credit is not transferable for money but will be used at the earliest convenience - usually the next term’s fees.

4b. Ongoing Absences

If a student will be absent for more than three weeks due to medical reasons, a credit may be given, at the discretion of IMAM management.

5. DURATION OF THE LESSON AGREEMENT - ONGOING

5a. The lesson agreement between IMAM and the student/parent is a rolling agreement that continues into each month. 

5b. The students/parents are emailed their invoices towards the end of each month in respect to the following term’s lessons until a cancellation notice is received, as discussed below.

6. CANCELLING THE LESSON AGREEMENT

6a. The student may opt out of the Lesson Agreement with IMAM.

6b. If the student/parent wishes to cancel the lessons with IMAM, written notice must be received by IMAM Management at least two weeks prior to the intended last lesson for our records. Any lessons remaining after the end date will be credited to the student's account if payment has already been made.

6c. Verbal notice will not be acted upon and is not considered sufficient unless confirmed in writing to IMAM.

6d. Exceptions on medical grounds may be made to this as decided by IMAM management.

6e. No refund or credit will be given once payment has been received. 

6f. If IMAM has to cancel a lesson, it will endeavor to give two weeks’ notice to the student. Any lessons remaining after the lessons’ end date will be credited to the student's account if payment has already been made.

6g. If in exceptional circumstances, IMAM must cancel the student's lesson due to damage to IMAM property or harassment of IMAM staff by the student, this may be done with no notice and no credit or refund for any outstanding lessons.

7. PAYMENTS

Payments can be made online through our secure automated system via PayPal, credit, debit card, or electronic check. Exceptions will be considered based on special circumstances. 

8. TUITION FEES AND ACCOUNTING

8a IMAM will not accept on-hand cash from students or parents/guardians.

8b. IMAM may assess a fee if payment is late.

8c. IMAM prefers online / Internet banking payments. Checks and e-checks will be accepted. 

8d. Students/parents will receive an invoice when their enrollment is processed and payment is made.

8e. Upon enrollment, a student/parent will be set up with a Customer Portal login. All Term fee invoices, payments, and lesson details are accessible there.

8f. Monthly, Quarterly or Semi-Annual plans can be set up via Wix and/or PayPal at the discretion of IMAM. A list of dates of when payment is to be made will be sent to you before the lesson, so any changes must be requested then.

8g. A discount will be applied to all lessons where three or more lessons/activities are attached to a single-family record on the IMAM database. This discount will not be applied retrospectively for any lessons already paid or billed. 

8h. Penalties for late payments will be applied as indicated in the Penalties section. 

9. PENALTIES

9a. Overdue accounts can accrue penalties of $30 when overdue for 28 days and $15 for every following 14-day period.

9b. LATE PAYMENT Penalties will be added to accounts that are 28 days behind. If the account remains overdue, further penalties will be added every 14 days.

9.b.ii. Late Penalty charges are made up of two parts - a $10 late fee and a $20 administration cost.

9.b.iii. Dishonored Internet Payments – the student’s account will be debited with a $10 fee if any online payment is annulled.

9.b.iv. Insufficient Check Payments - the student’s account will be debited with a $35 fee if any check payment is annulled.

9.b.v. The student’s parent is responsible for any and all charges that their bank may levy for rejecting any payment to IMAM.

9c. IMAM does reserve the right to temporarily and fully suspend students from lessons with unpaid term fees during term time. A temporary suspension means that IMAM will keep the lesson time slot available for the student in the hopes that payment will be made. A full suspension means that IMAM has the right to fill the student's lesson time slot with another student from the waitlist.

9d. DEBT COLLECTION DETAILS

9.d.i. IMAM will attempt numerous contacts prior to resorting to this unfortunate measure.

9.d.ii. All costs incurred for sending an account for debt collection are added to the student’s outstanding balance.

10. PHOTOGRAPHY & FILMING

10a. IMAM may use film or still photographs of IMAM students for appropriate promotional purposes.

10b. IMAM students/parents must inform IMAM if you will not allow the use of such images.

11. CHANGES TO THE TERMS AND CONDITIONS

The Terms and Conditions described above are agreed to upon enrollment and may be changed at any point by IMAM without providing prior notice. A copy of the Terms and Conditions will always be available on our website and may be emailed, upon request.
